Sutton Massachusetts General Bylaws
ARTICLE 28. SOLID WASTE HAULER REGULATIONS These general bylaws are official as of October 20, 2003. The are the last known revision as of March 17, 2007. Section 28.1 - Registration Of Collection Vehicles Trash collection vehicle owners shall register each and every vehicle employed specifically for solid waste collection in the Town of Sutton with the Sutton Board of Health. Section 28.2 - Issuance Of Permit; Fees A proper application form shall be submitted to the Board of Health and, upon inspection of carrier vehicles and approval of such, a permit will be issued upon a fee payment of an amount to be determined by vote of the Board of Selectmen for each vehicle, renewable annually on July 1. Section 28.3 - Marking Of Vehicles Each and every vehicle shall bear the firm or business’ name and the telephone number on both sides of the unit with letters and numbers no less than six (6) inches in height, plainly visible on both sides of the vehicle. Section 28.4 - Display Of Permit Each and every licensed vehicle shall conspicuously display within the vehicle the permit issued by the Board of Health. Section 28.5 - Damage To Property By Permit Holder The permit holder shall take all proper precautions to protect all property from unnecessary interference, injury or damage. If any property, excluding trash containers, is damaged through the fault of the permit holder or its employees or agents, it shall promptly repair or replace the same at its own expense. Section 28.6 - Haulers Responsibilities The permit holder shall perform solid waste collection services in such a manner as to meet all applicable federal, state and local safety and environmental rules and regulations and shall utilize vehicles maintained in good working order and operated in a manner to eliminate, as far as possible, objectionable odors, spillage and loose debris. Any waste spilled onto roadways or properties shall be cleaned up immediately. All solid waste hauling vehicles shall also be required to carry a Spill Kit for Medical Waste. Said kit shall include, at a minimum, caution tape, bleach, safety glasses, speedy-dry, eye wash, shovel, dust pan & brush, gloves and face mask. All vehicle operators shall also be trained and instructed by the vehicle owner as to the proper use of said Spill Kit and procedures related to hazardous material spills or situations. Section 28.7 - Enforcement Agents The Sutton Board of Health and its designees, and any police officer of the Town of Sutton shall have jurisdiction to enforce any and all provisions of this By-Law. Section 28.8 - Penalties & Fines Any person who violates any provisions of this chapter may, in the discretion of the town official who is the enforcing person, be penalized by a non-criminal disposition as provided in M.G.L.A. C. 40, § 21D. The fine for each such violation shall be as follows:
(1) For the first violation: warning. Section 28.9 - Severability If any section, paragraph, sentence, clause or phrase of the foregoing rules or regulations shall be decided invalid for any reason whatsoever, such decision shall not affect the remaining portion of these regulations, which shall remain in full force and effect; and to this end the provisions of these regulations are hereby declared severable.
